General

All Contracts entered into by ‘The Company’ and any person, firm or company (hereinafter referred to as ‘The Buyer) purchasing, hiring or leasing goods from ‘The Company’ shall be subject to the following terms and conditions, and the placing of an order by ‘The Buyer’ shall be considered as acceptance of these conditions.

Prices

Unless otherwise stated, all prices are net and are those ruling at the time of dispatch. Published price lists and quoted price lists, whilst given in good faith, are subject to change without notice due to suppliers’ price fluctuations and other causes beyond ‘The Company’s’ control. Quoted prices apply only to stipulated quantities and do not hold for lesser quantities. Any quotations are valid for a period of 30 days (unless otherwise stated).

VAT will be added at the current rate to all invoices unless the customer provides a valid VAT exemption Certificate with each order.

Payment

We except all major Credit and Debit cards.

Delivery

You must inspect the goods on delivery. If any goods are damaged or not delivered you must notify ‘The Company’ within 48 hours of the delivery and write to confirm your claim within 7 days of delivery. You must give us (and the carrier) a fair chance to inspect that damaged goods. If you fail to notify us in accordance with these requirements, you will be deemed have accepted the goods and full payment will be required. Delivery is free to within the mainland UK for all orders over £75.00 net. ‘The Company reserves the right to make a carriage charge plus 15% handling charge on all consignments entered for deliveries which are refused.

Warranties

We warrant that the goods:

a)      Will comply with their descriptions

b)      Are of satisfactory quality; and

c)      Are free from material defect at the time of delivery (as long as you comply with the next clause)

If you believe that we have delivered goods that are defective in materials or workmanship, you must:

a)      Inform us (in writing), with full details, as soon as possible; and

b)      Allow us time to investigate (we may need access to your premises and product samples)

If the goods are found to be defective in material or workmanship (following our investigations), and you have complied with those conditions (in clause above) in full, we will (at our option) replace the goods or refund the price.

We also warrant that we will pass goods title to you.

We give no other warranty and make no representation as to the quality of the goods or their fitness for any purpose. Save as expressly set out above, we exclude, to the extent permissible by law, any warranty, term or condition that would otherwise be implied by law, customary practice or a course of dealing. You agree that we shall not be liable for loss of business, revenue or profits or loss of use, nor shall we be liable for special, indirect or consequential loss or damage, in each case arising from or in connection with the contract or the supply of goods or their own use, even if we are negligent or aware of the nature of loss which may be suffered.

Return of Goods

We will accept the return of goods only:

a)      By prior arrangement (quoting ‘The Company’s’ original invoice or order number)

b)      On payment of an agreed handling charge (Unless the goods were defective when delivered) if the reason for return was not of ‘The Company’s’ causing.

c)      Where the goods are as fit for sale on their return as they were on delivery (in original packaging and undamaged)

d)      Within 21 days of delivery (work wear within 14 days) (drug trolleys within 5 days)

Title of Goods

All goods supplied will remain the legal property of ‘The Company’ until the debts owed to ‘The Company’, including any balances existing at the relevant time are settled. The risk shall pass to ‘The Buyer’ on delivery.

Any loan or hire products also remain ‘The Company’s’ property and we have your permission to enter any premises where goods may be stored:

a)      At anytime, to inspect them

b)      To remove them using reasonable force if necessary.

Despite our retention of title to the goods, if not in working order, we have the right to take legal proceedings to recover the price of the goods supplied should you not pay us by the due date.

Description of Goods

Please note that all items are sold by product description and not product code. Product codes are listed to enable identification of goods within ‘The Company’ and no guarantee of any specific manufacturers/suppliers products are to be inferred from such references. Product codes MUST be used with all orders. We reserve the right to alter without prior notice any details contained herein in the interests of product development.

VAT Relief Information

Conditions for VAT relief for disabled people

Some of the products which can be purchased from the Hcsuk website are available for an eligible person to purchase without paying VAT on them. HM Revenue and Customs sets out the conditions when equipment for disabled people might be free of VAT and how to claim exemption from paying VAT on these products.

Products a can only be exempt from VAT when all the following conditions are met:

  1. The customer is eligible to purchase supplies at the zero rate
  2. The goods are for the personal or domestic use of the customer
  3. The goods and services are eligible to be supplied at the zero rate

A more detailed explanation of each of these conditions is given below, but you should visit the HM Revenue and Customs Website to fully understand the conditions

The product must be being purchased for someone who is chronically ill or disabled.

A person is ‘chronically sick or disabled’ if he/she is a person:

It does not include a frail elderly person who is otherwise able-bodied or any person who is only temporarily disabled or incapacitated, such as with a broken limb.

‘personal or domestic’ use means that the supply must be made available specifically for the use of an eligible individual.

You don’t have to physically buy the goods in person. If your parent, guardian or wife or husband buys the goods and services for you, then you won’t be charged VAT.

What counts as personal or domestic use?

Personal or domestic use means that the goods or services are supplied for your own private use, rather than for business purposes. Also, the goods or services must be just for your own use – not for use by anyone else, or chronically sick or disabled people in general. However, if you and your partner are both chronically sick or disabled and you buy goods or services for both of you to use, then you won’t have to pay VAT.

Products which are offered for sale on this website which qualify for VAT relief to be claimed for an eligible person.

Only the products on our site carrying the VAT exemption price (the smaller price marked ex VAT) are eligible to be purchased this way and you must tick the box on the basket page indicating that you wish to claim VAT exemption on the items in your basket that are eligible for VAT relief.

How to claim

On the my basket page of this website a link to the online declaration form is provided if the basket contains a product that qualifies for VAT relief. You must tick the box to state you wish to claim VAT relief on the eligible product and complete in full the reason by which you are ‘chronically sick or disabled’ and name and address of the claimant. If possible the person making the claim should complete this form, but a family member, carer or medical professional may complete the form on the claimants behalf. To submit the claim and receive the VAT relief, click the ‘Submit VAT Relief Claim’ button before proceeding to the checkout.

Please note that all orders submitted with a VAT relief claim form completed are checked before the order is processed.

It is necessary to complete a separate claim form each time a qualifying product is purchased from Hcsuk.
